Welcome to Libercube!
These Terms of Service (the "Terms") are an agreement between you (or, for a minor user, your parent or guardian) and LumiLoki (Chongqing) Tech Co.,Ltd. ("we", "us", or "our") regarding your use of the Libercube software and related services (the "Services"). The Services include account services, smart cube Bluetooth connection, cube color recognition, training and result records, and 1v1 online matches.
This product is available on the App Store in the United States, the European Union / European Economic Area, and the United Kingdom. Please read these Terms together with our Privacy Policy before using the Services. Together, the two documents form the complete agreement between you and us.
1. Please read these Terms carefully before using our Services. By tapping agree, registering, signing in, or actually using the Services we provide, you represent that you have fully read, understood, and accepted these Terms in full, and these Terms become legally binding between you and us.
2. We may modify these Terms when necessary. We will publish the modified Terms through appropriate means such as in-app notices, pop-ups, or on-page prompts. If you continue to use our Services, you are deemed to have accepted the modified Terms. If you do not agree to the modifications, you should stop using the Services or the related features. If you are a consumer in the European Union, the European Economic Area, or the United Kingdom, we will give you reasonable prior notice of material changes as required by applicable consumer law, and those changes will not affect rights you have already acquired.
3. If you are a minor, please read these Terms together with your parent or guardian, and let them decide whether to agree. Your use of the Services is deemed to mean that your parent or guardian has read and agreed to these Terms in full.
This product is intended for users of all ages, including children. When a user is a child or a minor, account registration must be completed by a parent or guardian: the registration flow requires a parent/guardian email address, which must be verified. An account is created and activated only after email verification is completed and the parent or guardian confirms agreement to these Terms and the Privacy Policy. Registration requests that have not completed guardian verification will not be activated.
For users in the United States, we obtain verifiable parental consent before collecting personal information from children under 13, as required by the Children's Online Privacy Protection Act (COPPA). For users in the European Union, the European Economic Area, or the United Kingdom, where information society services are offered directly to a child, we obtain consent from a parent or guardian in line with the applicable digital consent age (16 under the GDPR, unless a Member State has set a lower age of not less than 13).
The parent or guardian is responsible for the minor's conduct while using the Services, including but not limited to account security, spending (if applicable), and interactions with other users. A parent or guardian may at any time, through the verified email address or the contact information at the end of these Terms, access or correct the minor's account information, or request account deletion or termination of these Terms.
1. You (or the parent/guardian of a minor user) should provide true, accurate, and complete information when registering an account.
2. Your account may be used only by you (or by the minor under your guardianship). Gifting, lending, renting, transferring, or selling the account is prohibited.
3. You are responsible for all activity under the account. If you discover that the account is being used without authorization or that a security vulnerability exists, you should notify us immediately through the contact information at the end of these Terms.
4. You may request account deletion at any time through the related feature in the App. Deletion of a minor's account must be initiated by the parent or guardian through the verified email address. The specific process and how data is handled are described in the "Account Deletion and Cancellation" section of the Privacy Policy.
1. Smart cube connection: The Services support connecting compatible smart cube devices over Bluetooth and syncing cube state in real time. Connection quality may be affected by your environment, device compatibility, and other factors. We do not warrant the quality or performance of third-party smart cube hardware itself.
2. Cube color recognition: This feature uses the device camera to perform image recognition locally on the device. Accuracy of the recognition results may be affected by lighting, camera performance, and other factors.
3. 1v1 online matches: The Services provide real-time online matches over the network. To protect minor users, this feature does not provide open text chat or private messaging. During a match, we only display timing, solve status, and other information related to the match itself. Network conditions may affect the real-time performance and stability of matches.
4. We may, based on product plans, add, adjust, or discontinue certain features from time to time, and we will notify you through in-app notices or similar means. If you are a consumer in the European Union, the European Economic Area, or the United Kingdom, we will not make a change that significantly reduces the core features of the Services without providing reasonable notice, except where we must do so for security, legal, or operational reasons.
When using the Services, you (or a minor user under the guidance of a guardian) should comply with applicable laws and regulations in your region, and must not engage in any of the following:
If we discover or receive reports that you (or a minor under your guardianship) have engaged in any of the above, we may take measures under Section 7 of these Terms.
1. Intellectual property in the Libercube software and related trademarks, icons, interface designs, program code, and similar materials belongs to us or the respective rights holders and is protected by applicable law. Without our written permission, you may not copy, modify, distribute, sell, or otherwise exploit the foregoing, except as otherwise provided by law.
2. You retain the corresponding rights in content you upload or generate through the Services (such as nicknames, avatars, and training records). You grant us a license to use, store, and display that content to the extent necessary to provide, maintain, and improve the Services.
If you (or a minor under your guardianship) violate these Terms, the Privacy Policy, or applicable laws and regulations, we may, depending on the seriousness of the circumstances, issue a warning, restrict certain features, suspend or terminate the Services provided to you, and we reserve the right to pursue corresponding liability in accordance with law. We will try to notify you in advance where reasonably practicable, except in urgent situations (such as security risks or fraud).
You may also terminate these Terms at any time by deleting your account. How data is handled after account deletion is described in the Privacy Policy.
1. United States and other users who are not consumers in the EU, EEA, or United Kingdom: To the maximum extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis. We do not warrant that the Services will be uninterrupted, timely, secure, or error-free. To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Services. Our aggregate liability shall not exceed the greater of (i) the fees you paid for the Services in the 12 months before the claim arose, or (ii) US$100.
2. Consumers in the European Union, the European Economic Area, or the United Kingdom: Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable consumer law. Statutory rights, including rights relating to digital content and digital services under applicable EU or UK consumer protection law, are not affected. Where our liability may lawfully be limited, it is limited to the fees you paid for the Services in the 12 months before the claim arose (if the Services are provided free of charge, a reasonable amount determined under applicable law).
3. This section does not affect other rights granted to you by applicable law that cannot be excluded by agreement.
We may assign or transfer these Terms, in whole or in part, in connection with a merger, acquisition, reorganization, or sale of assets, and will notify you of any assignment that materially affects you. You may not assign or transfer these Terms without our prior written consent.
United States and other users who are not consumers in the EU, EEA, or United Kingdom: These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. If any dispute arises regarding the content or performance of these Terms, the parties should first attempt to resolve it through friendly consultation. If consultation fails, you may contact us through the contact information at the end of these Terms, or bring proceedings in the state or federal courts located in Delaware, except where applicable law requires otherwise.
Binding arbitration; class action waiver (United States users only). Any dispute arising out of these Terms shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring claims in small claims court or seek injunctive relief for intellectual property infringement. You and we agree that proceedings will be conducted only on an individual basis and not as a class, consolidated, or representative action. You may opt out of arbitration within 30 days of first accepting these Terms by emailing software@lumiloki.com. This paragraph does not apply to consumers in the EU, EEA, or UK.
Consumers in the European Union, the European Economic Area, or the United Kingdom: These Terms are governed by the laws of the State of Delaware, United States, except that you also enjoy the protection of the mandatory provisions of the law of your country of residence. You may bring proceedings in the courts of Delaware, or in the courts of the place where you are domiciled. We may bring proceedings against you only in the courts of the place where you are domiciled. If you are an EU consumer, you may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. We are not obliged to participate in alternative dispute resolution before a consumer arbitration board unless required by law.
To the maximum extent permitted by applicable law (and, for consumers, only where such terms may lawfully be agreed), you agree to indemnify and hold harmless LumiLoki and its officers, employees, and partners from claims, damages, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or applicable law, or content you submit, except to the extent caused by our breach or negligence.
1. If any provision of these Terms conflicts with a mandatory provision of applicable law, that provision shall not apply to the extent of the conflict, without affecting the validity of the remaining provisions of these Terms.
2. The headings in these Terms are for convenience of reading only and do not affect the interpretation of the provisions.
3. These Terms and our Privacy Policy together constitute the complete agreement between you and us regarding use of the Services. If there is a conflict between the two documents, the Privacy Policy prevails with respect to the processing of personal information.
